III. Online Store – Registration and User Account
Article 7 | Use of the Online Store
The user may use the online store as a registered user with a user account or without registration.
Registration is not a condition for using the online store or placing an order, unless otherwise specified for a particular functionality or service.
Article 8 | Registration and User Account
By registering, the user can create a user account that allows them to use additional functionalities of the online store, in particular viewing and managing their data and viewing past orders.
Registration is voluntary. When registering, the user must provide the required information, which must be accurate, complete and up to date.
Article 9 | Registration via the Online Store
To register, the user enters the information required by the online store and completes the registration procedure as set out on the website.
After successful registration, the user gains access to their user account. If confirmation of the email address is required to complete the registration, the user does so via the link sent to their email address.
The user must protect their login details and password and may not disclose them to third parties.
The user is responsible for actions carried out through their user account, unless they prove that the account was used through no fault of their own or due to circumstances for which they are not responsible.
Article 10 | User Account
The user must ensure that their user account is used only by themselves or by a person they have duly authorised.
The user must notify Alpina without undue delay of the loss, theft or disclosure of their login details, or of any suspected unauthorised use of their user account.
The user is responsible for the accuracy and currency of the information entered in their user account. The user must update any changes in their user account or notify Alpina of them where changes cannot be made in the user account.
The user may close their user account or request its deletion at any time in the manner provided in the online store, or by sending a request to Alpina at the contact email address published on the website.
Closing the user account does not affect sales contracts already concluded, the rights and obligations arising from them, or Alpina’s obligations regarding the retention of data and documentation where such retention is based on applicable regulations or another appropriate legal basis.
More detailed information on the processing of personal data in connection with registration, the user account and the use of the online store is provided in Alpina’s Privacy Policy.
IV. Online Store – Purchase of Products
Article 11 | Prices
All product prices in the online store are stated in EUR and include value added tax (VAT), unless expressly stated otherwise. Prices do not include delivery costs, which are shown to the customer before the order is placed.
Prices published in the online store apply to purchases made through the online store and may differ from prices in Alpina stores across Slovenia.
Product prices may change without prior notice. Each order is subject to the price published for the product in the online store at the time the order was placed, or the price confirmed for the specific order in accordance with the ordering procedure.
Alpina strives to provide accurate and up-to-date product price information. Nevertheless, technical, system or other errors may result in an incorrectly published price. If, after an order has been placed, Alpina discovers an obvious error in the price of a product, it will notify the customer as soon as possible and allow them to confirm the order at the correct price or to reject it. If the customer does not confirm the order at the correct price, the order is cancelled and any purchase price already paid is refunded to the customer.
When displaying discounts and promotional prices, Alpina uses terms such as “regular price”, “reduced price” and “previous price” in accordance with applicable regulations.
“Previous price” means the lowest price applied by Alpina during a period of at least 30 days before the application of the reduced price, or the lowest price applicable in the case of a gradual, continuous price reduction, in accordance with applicable regulations.
Article 12 | Discounts and Promotions
Promotional and reduced prices in the online store are specially marked and are valid for the period stated for each promotion, or while stocks last, if so stated.
Unless expressly stated otherwise, the discount is applied to the product price and not to delivery costs.
Individual promotions, discounts, promo codes, gift vouchers or other benefits may be mutually exclusive or may not be combined. The terms of each promotion are stated with the promotion or wherever else the promotion is presented.
Promotions and discounts valid in the online store are not necessarily the same as those valid in Alpina stores across Slovenia, and vice versa.
Unless expressly stated otherwise, discounts and promotional benefits are not taken into account when calculating other discounts or benefits.
Article 13 | Payment Methods
The customer may pay for an order in the online store using the payment methods available to the customer and displayed during the ordering process.
The following payment methods in particular may be available in the online store:
Payment by pro forma invoice
The customer may pay for products ordered from the online store by pro forma invoice, either via online banking or in person at a bank or post office.
After the order is placed, Alpina sends the customer a pro forma invoice with payment instructions to their email address. The order is processed and the products are dispatched once payment has been received in Alpina’s bank account.
The payment deadline for the pro forma invoice is three (3) working days. If Alpina does not receive payment within this period, it may consider that the customer has withdrawn from the order and cancel the order.
When paying by pro forma invoice, the customer enters the details stated on the pro forma invoice when completing the universal payment order (UPN).
Payment details:
- Purpose of payment: Payment for order no. XXXXX
- Recipient: Alpina, d.o.o.
- Address: Strojarska ulica 2, 4226 Žiri, Slovenia
- IBAN: SI56 0400 1004 9700 946
- BIC: KBMASI2X
- Reference: SI00 XXXXX-639401-77
(XXXXX stands for the number of the specific order.)
Cash on delivery
Cash on delivery is possible exclusively in cash upon receipt of the goods. The recipient of the parcel is also the payer and must pay the full amount of the order upon receipt.
Parcels are delivered by Pošta Slovenije d.o.o. or by another delivery provider designated by Alpina.
Payment by debit or credit card
Payment is possible with the following payment cards: Visa, Visa Electron, Mastercard, Activa Maestro, Activa, BA and Diners Club.
Payment is also possible via PayPal, Apple Pay and Google Pay.
Online card payments are processed through a secure online payment system or payment service provider used by Alpina. After completing the ordering process, the customer is redirected to the website or payment environment of the payment service provider, where they enter or confirm the details required to make the payment.
Alpina does not have access to the full payment card details entered by the customer in the payment service provider’s payment environment.
Payment with a Diners Club card may allow purchases in up to 6 instalments, in accordance with the terms of the card provider or issuer.
Alpina may change the range of available payment methods. For each order, the customer can choose from the payment methods displayed during the purchasing process.
Any restrictions or special conditions of a particular payment method are shown to the customer before the order is placed.
Article 14 | Retention of Title
All products purchased through the online store remain the property of Alpina until paid for in full.
Article 15 | Delivery and Collection of Products
Alpina delivers ordered products to the area specified in the online store or during the ordering process.
During the purchasing process, the customer may choose from the delivery or collection methods available at that time, in particular:
- delivery to an address specified by the customer;
- free collection at a selected Alpina store, if this option is available for the specific order.
Delivery costs are shown to the customer before the order is placed. If the order meets the conditions for free delivery, no delivery costs are charged.
Orders within the Republic of Slovenia are delivered by Pošta Slovenije d.o.o. or by another delivery provider designated by Alpina. Delivery to a post office box is not possible.
If the customer is unable to receive the order at the first delivery attempt, the parcel may be collected in accordance with the delivery provider’s instructions. If the customer does not collect the parcel within the period set by the delivery provider, the parcel may be returned to Alpina.
When collecting an order at a selected Alpina store, the customer receives a notification when the order is ready for collection. Products for collection at the selected store can be collected within 10 working days. After this period, Alpina may cancel the order and, if payment has already been made, refund the purchase price to the customer.
To ensure safe delivery, Alpina or the delivery provider may verify the identity of the person collecting the order in an appropriate manner.
Article 16 | Delivery Costs
For deliveries within the Republic of Slovenia, the delivery costs published in the online store and shown to the customer before the order is placed apply.
Current delivery costs are:
- for orders over EUR 40.00, delivery is free of charge;
- for orders up to and including EUR 39.99, the delivery cost is EUR 3.99.
Collection of an order at a selected Alpina store is free of charge, if this option is available for the specific order.
As part of promotions, Alpina may set different delivery conditions, including free delivery, which will be specifically stated in such cases.
Article 17 | Dispatch and Delivery Times
Products in stock are generally dispatched by Alpina within 1 to 4 working days after the order has been confirmed or, for orders where payment is a prerequisite for dispatch, after payment has been received.
The delivery time depends on the delivery method and the delivery provider. The estimated delivery time or any information on delivery times is shown to the customer during the purchasing process or in the order confirmation, where possible.
For orders consisting of several products, individual products may be dispatched in several separate parcels due to differing availability or other logistical reasons. In such cases, Alpina does not charge the customer additional delivery costs if these arose solely from Alpina’s partial dispatch of the order.
Delivery times are estimates and may be extended due to circumstances beyond the control of Alpina or the delivery provider. If such circumstances cause a significant delay, Alpina will notify the customer where possible.
The stated delivery times do not affect the consumer’s statutory rights in the event of delay in the performance of contractual obligations.
Article 18 | Purchasing Procedure
Orders in the online store are placed in the language or languages available on the website.
The customer may select products from the online store’s range and add them to the shopping cart.
The purchasing procedure generally consists of the following steps:
Step 1 – Selecting products and adding them to the shopping cart
Add the product you wish to buy to the cart by clicking the “Add to cart” button. When you have finished shopping, click the “Checkout” button. If you want to add more products to the cart, click the “Continue shopping” button.
You can add any number of products to the cart. In the cart, you can view the list of selected products at any time, change the quantity or remove a product from the cart. When you have finished adding products to the cart, click the “Next” button.
Step 2 – Registration or user login
Once you have added all the desired products to the cart, proceed to the next step, where you enter the details to start your order. If you are already registered in the online store, select “Log in” and enter the username and password you received when registering. If you are not yet registered in the online store, select “Register as a new user” and fill in all the required registration details. If you want to make a purchase without registering, select “Checkout without registration”, where you only need to enter your contact email address. Proceed to the next step.
Step 3 – Delivery address
Next, enter or review the contact details for delivery. Registered users of the online store should check the contact details already entered in this step. If you selected the option to purchase without registration in the previous step, enter all the required contact details in this step. If you want delivery to a different address, click “I want to receive the products at a different address” and enter the contact details for delivery to the desired address, or select a parcel locker or collection at a selected Alpina store. A phone number for delivery is mandatory. Before continuing, click “I accept the terms of purchase” to confirm that you have read and agree to the Terms and Conditions.
Step 4 – Payment
Next, select a payment method. You can choose from three payment methods, namely:
- cash on delivery; once the administrator has confirmed and processed your order, the goods will be sent to your delivery address. Before delivery, the courier will call you to let you know the estimated delivery time. You will pay for the ordered products in cash upon receipt.
- payment by pro forma invoice; upon confirmation of the order, we will send a pro forma invoice to your email address. Once the pro forma invoice has been paid and the order confirmed, the goods will be dispatched. Before delivery, the courier will call you to let you know the estimated delivery time.
- payment by debit or credit card; after placing the order, you will be automatically redirected to a website where you will enter your credit card details and make the payment. After choosing the payment method that suits you best, click the “Next” button.
- payment via the online payment services PayPal, Apple Pay or Google Pay; after selecting a payment service, you will be redirected to the relevant secure payment environment or will confirm the payment in accordance with the instructions of the selected service.
Step 5 – Order review
Next, review your order. The ordered products and the payer and delivery details are displayed on the screen. In this step, you can change the quantities and contents of the cart in the previous steps, which you can access by clicking the “Back” button. After clicking the “Complete purchase” button, you will receive a confirmation email in your inbox, in which you should click the link. By clicking the link, you authorise the order.
Step 6 – Confirmation of receipt of order
Alpina reviews the order and checks, in particular, the availability of the ordered products and other circumstances relevant to the execution of the order. If the order is confirmed, Alpina sends the customer an order confirmation email or confirms it in another manner specified in the purchasing process.
If an ordered product cannot be supplied or there are other justified circumstances preventing the execution of the order, Alpina notifies the customer and, where necessary, offers an appropriate solution or cancels the order. If payment has already been made, the amount paid is refunded to the customer in accordance with applicable regulations.
The sales contract is concluded at the moment specified in the purchasing process and in these Terms and Conditions.
Article 19 | Changing or Cancelling an Order
The customer may send a request to change or cancel an order to the online store’s contact email address as soon as possible after placing the order.
Alpina will accept the request if the order has not yet been dispatched or if the change or cancellation is still technically possible.
If the change or cancellation can no longer be carried out due to the stage of order processing, the customer may exercise their rights in accordance with the provisions of these Terms and Conditions on withdrawal from the contract or return of products.
Article 20 | Invoice
The seller must issue an invoice for the supply of products or services and deliver it to the customer. You will receive the invoice in printed form together with the product and by email when the product is dispatched.
Article 21 | Product Availability
All products presented in the online store are available while stocks last or until the product is withdrawn from the range.
Alpina strives to provide accurate and up-to-date information on product availability; however, technical or other reasons may cause discrepancies between the displayed stock level and the actual availability of a product.
If, after an order has been placed, we find that an ordered product can no longer be supplied, Alpina will notify the customer as soon as possible. If an ordered product cannot be supplied, Alpina may offer the customer another comparable product, where possible. The customer may accept or reject such an offer. If the order or an individual product cannot be supplied and the customer has already paid for it, Alpina will refund the corresponding amount paid to the customer.
V. Online Store – Withdrawal from the Contract
Article 22 | Right of Withdrawal – Exchange or Return of a Product
A customer who is a consumer has the right, in accordance with the applicable Consumer Protection Act (ZVPot-1), to withdraw from a distance contract within 14 days without giving any reason.
The withdrawal period begins on the day the consumer, or a third party other than the carrier designated by the consumer, takes possession of the parcel with the product. If several products ordered under the same contract are delivered separately, the period begins on the day the consumer takes possession of the last parcel.
The consumer exercises the right of withdrawal by sending Alpina, before the expiry of the said period, an unequivocal statement clearly setting out their decision to withdraw from the contract. It is recommended that the statement also include the order number or other details that allow the order to be identified. To exercise the right of withdrawal, the consumer may use the Withdrawal Form published on the Returns and Exchanges page of this online store. The consumer returns the product to Alpina without delay and no later than 14 days after sending the notice.
The notice of withdrawal may be sent to the email address: podpora@alpina-footwear.com.
Article 23 | Exchange of a Product
Exchanges are possible for products that have not been worn. The product must be undamaged, in its original quantity and show no signs of use. You may inspect and try the product to the extent necessary to establish its nature, characteristics and functioning. If you handle the product beyond that extent, you are liable for any diminished value in accordance with ZVPot-1.
You may hand in the product at any Alpina store in Slovenia (except the Lucija and Sežana stores) or pack it in a parcel and send it to our address: Alpina, d.o.o., Strojarska ulica 2, 4226 Žiri, Slovenia, marked “ONLINE STORE”. The product must be accompanied by a completed Withdrawal Form (published on the Returns and Exchanges page) and a copy of the invoice. In addition to your details, state on the form which other product you would like. We will send you the ordered product as soon as possible. The cost of sending the returned product is borne by the customer.
If you wish to exchange a product for the same product in a different size, you can do so at any Alpina store in Slovenia that has the selected product in stock. You can also check store stock in the Alpina online store at www.alpina-footwear.com.
The exchange option is an additional option provided by Alpina and does not affect the consumer’s statutory right of withdrawal.
Article 24 | Return of a Product
Returns are possible for products that have not been worn. The product must be undamaged, in its original quantity and show no signs of use. You may inspect and try the product to the extent necessary to establish its nature, characteristics and functioning. If you handle the product beyond that extent, you are liable for any diminished value in accordance with ZVPot-1.
You may hand in the product at any Alpina store in Slovenia (except the Lucija and Sežana stores) or pack it in a parcel and send it to the address: Alpina, d.o.o., Strojarska ulica 2, 4226 Žiri, Slovenia, marked ONLINE STORE. The product must be accompanied by a completed withdrawal form (published on the Returns and Exchanges page) and a copy of the invoice. The cost of sending the returned product is borne by the customer.
Article 25 | Refund of the Purchase Price
In the event of a valid withdrawal from the contract, Alpina refunds all payments received from the consumer, including the costs of standard delivery, without undue delay and no later than 14 days from the day on which Alpina was informed of the consumer’s decision to withdraw from the contract.
Notwithstanding the above, Alpina may withhold the refund until it has received the returned product or until the consumer has provided proof that the product has been sent back.
Alpina refunds the purchase price using the same means of payment that the consumer used for the online purchase. If the consumer wishes to receive the refund to a bank account, they should enter the bank account number on the Withdrawal Form.
Article 26 | Cases in Which the Right of Withdrawal Does Not Apply
The consumer does not have the right to withdraw from the contract in cases where the right of withdrawal is excluded by applicable law.
Among other things, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised, or to other cases for which applicable law provides an exception to the right of withdrawal.
VI. Online Store – Liability for Product Conformity
Article 27 | Liability for Product Conformity
Alpina is liable for any non-conformity of a product in accordance with the applicable Consumer Protection Act (ZVPot-1). Goods are non-conforming in particular where the product does not correspond to the agreed type, quantity, quality and other characteristics it must have under the contract or under Articles 72 and 73 of ZVPot-1.
If a non-conformity of the product becomes apparent within one year of delivery, it is presumed by law that the non-conformity existed at the time of delivery, unless Alpina proves otherwise or this presumption is incompatible with the nature of the product or the nature of the non-conformity.
Alpina may not limit or exclude its liability for non-conformity of a product by contractual provisions.
Article 28 | Warranty Claims for Non-Conformity
In the event of non-conformity of goods, the consumer has the right to request that the product be brought into conformity free of charge under the conditions laid down by applicable legislation.
Alpina must bring the goods into conformity within a reasonable period, which as a rule may not exceed 30 days from the notification of non-conformity. Under the conditions laid down by applicable legislation, this period may be extended by a maximum of 15 days.
If conformity of the goods is not restored in accordance with applicable legislation, the consumer may request a proportionate reduction of the purchase price or withdraw from the sales contract and request a refund of the purchase price paid, if the statutory conditions for this are met.
Notwithstanding the previous paragraph, the consumer may withdraw from the sales contract and request a refund of the purchase price paid if the non-conformity of the goods appears less than 30 days after delivery of the goods.
The consumer does not have the right to withdraw from the sales contract if the non-conformity is only minor. The burden of proof in this respect lies with Alpina.
Article 29 | Exercising Rights Arising from Non-Conformity
You may exercise your rights arising from non-conformity if you notify Alpina of the non-conformity within two months of the day on which the non-conformity was discovered and within two years of delivery of the product. In the notification of non-conformity, you must describe the non-conformity precisely and allow Alpina to inspect the product.
You can report a non-conformity by returning the product together with a copy of the purchase invoice and a completed Complaint Form (published on the Claims page), in which you describe the non-conformity found, to the address: Alpina, d.o.o. Strojarska ulica 2, 4226 Žiri, Slovenia – marked COMPLAINT, or to any Alpina store in Slovenia (except the Lucija and Sežana stores). Alpina only accepts cleaned products for processing.
If the existence of a non-conformity is disputed, Alpina will notify you of this in writing within eight days of receiving your warranty claim.
If a non-conformity is found and your claim is justified, Alpina will cover the necessary costs of bringing the goods into conformity in accordance with applicable legislation, including shipping costs.
For further information, you can contact us by email: reklamacije@alpina.si.
Article 30 | Return of the Product after the Complaint Procedure
After the procedure for exercising rights arising from non-conformity of goods has been completed, Alpina notifies the customer of the completion of the procedure and of how the product can be collected.
If the customer sent the product to Alpina by post to make a complaint, Alpina will send the product, after the complaint procedure has been completed, to the delivery address provided by the customer when making the complaint or as otherwise agreed with the customer.
If the customer handed in the product at an Alpina store to make a complaint, the customer collects the product, after the complaint procedure has been completed, at the same store where it was handed in. At the customer’s request or on the basis of a different agreement between Alpina and the customer, a product handed in at a store may be sent to the customer’s address after the complaint procedure has been completed. The customer must provide correct and complete information necessary for the delivery or collection of the product.
Article 31 | Product Information and Photographs
Alpina strives to ensure that the descriptions, data, specifications and other product information published in the online store are accurate, complete and up to date.
Product photographs in the online store may be illustrative or may differ slightly from the actual appearance of the product, particularly with regard to colour shades, due to the technical characteristics of the screen, lighting during photography or other circumstances. Such differences do not in themselves constitute a non-conformity if the product otherwise has the characteristics agreed in the contract or required by law.
Alpina reserves the right to change descriptions, technical data, photographs and other product information; however, such changes do not affect the customer’s rights arising from a contract already concluded.
VII. Online Store – Purchases by Companies
Article 32 | Purchases by Companies and Other Legal Entities
Products may also be purchased through the online store by companies, sole traders and other legal entities with their registered office in the Republic of Slovenia (hereinafter: “company”). The provisions of these Terms and Conditions that apply to purchases by customers who are natural persons apply mutatis mutandis to purchases by companies, unless otherwise provided in this chapter or by applicable law.
A company may make a purchase in the same way as other customers. During the purchasing or registration process, the user may indicate that they are making the purchase for a company and enter the details required to issue an invoice to the company. When purchasing for a company, the user must provide accurate, complete and up-to-date information, in particular the name or business name of the company, its business address, registered office, company registration number and tax number or VAT identification number, where required or where the company has one.
If the user provides company details as invoicing details when placing an order, the order is deemed to be placed in the name and on behalf of that company. A user placing an order in the name and on behalf of a company warrants that they are the legal representative of the company or are authorised by the company to conclude the sales contract.
If Alpina is unable to establish the existence of the company on the basis of publicly available records or registers, Alpina is entitled to contact the user and request that they provide proof of its existence within a reasonable period, or, at its own discretion, to reject the order received.
If insolvency, voluntary liquidation or compulsory liquidation proceedings have been initiated against the company, Alpina may reject the order before confirming it, or request advance payment or appropriate security for payment. If the contract has already been concluded, the rights of the contracting parties are assessed in accordance with applicable regulations.
Article 33 | Rights and Obligations of Companies
A company purchasing in the course of its trade, business or profession is not considered a consumer. Therefore, the provisions of these Terms and Conditions that are expressly intended to protect consumers do not apply to it, unless applicable law provides otherwise.
A company does not have the right to withdraw from the contract without giving any reason in accordance with Article 21 of these Terms and Conditions, unless such a right has been expressly agreed or is provided for by applicable law. Where a company is entitled under these Terms and Conditions or by law to withdraw from the contract and receive a refund of the purchase price, the method of refunding the purchase price to the business customer is determined according to the payment method used or by agreement between the contracting parties. A company is entitled to make warranty claims for material defects in accordance with the Obligations Code, unless the law provides otherwise.
VIII. Final Provisions
Article 34 | Access to the Sales Contract
The sales contract is kept at Alpina’s registered office and can be obtained upon written request. Please send your request to the address: Alpina, d.o.o., Strojarska ulica 2, 4226 Žiri, Slovenia, marked “ONLINE STORE”, or to the email address alpina-footwear.com. The concluded contract will be available at Alpina for six (6) months after its conclusion.
Article 35 | Governing Law and Dispute Resolution
These Terms and Conditions, their interpretation and the legal relationships between Alpina and the customer arising from the use of the online store or the purchase of products are governed by the law of the Republic of Slovenia.
If the customer is a consumer residing in another country, this choice of law does not affect the protection afforded to them by the mandatory provisions of the law of the country of their habitual residence.
Alpina does not recognise any out-of-court consumer dispute resolution provider as competent to resolve consumer disputes under the law governing out-of-court resolution of consumer disputes, unless it is obliged to cooperate with a particular provider under applicable law.
Alpina strives to resolve any complaints, claims and disputes with customers amicably in the first instance. Disputes shall be resolved by the courts having jurisdiction in accordance with applicable EU and national law.
Article 36 | Final Provisions
